Your Emails: AES: Dishonest, unfair & outright fraudulent! We need to fight back!

I was so glad to find this site. I too have had numerous problems with AES. Again, my credit is damaged due to their poor business practices.

The most recent problem comes after I requested that my terms be adjusted to a graduated payment. I was told that I need not make a payment in Dec. In January, after I made my payment, I received notice of payment delinquency (from December), I contacted AES on January 29 and was told that the error was theirs. They stated that there was an error when the account was updated and that the person who updated the account had failed to take the necessary measures to update the account in a manner that would reflect that the December payment had been made. Again, I was assured that I did not owe the December payment & that everything had been taken care of and I would receive no further notices. I was apologized to for the inconvenience it had caused me.

On March 2, I received a notice from a collection agency on behalf of AES/National Collegiate Trust. For the 3rd time, I contacted AES. Only this time I was told that I am responsible for interest & Late fees & the payment from December! I was told at this time that the December payment was not eligible for forgiveness due to no forbearance time left on the account. This was the first time anyone mentioned the need for forbearance time to relieve 1 payment! I have consistently been told I was not responsible, Why all of a sudden should I be held accountable for their error. I have no problem making the payment (if it is tacked onto the end of the loan as I can't afford to make the payment at this time.) I do not feel that my credit should suffer, nor should I be liable for late fees, etc. This was not an omission on my part, I had planned to make the payment!

As I stated before, this is the most recent of many problems I have had with AES; Pulling my loan out of forbearance 3 months early & not notifying me, then turning the account over to their attorney; Astronomical interest accrual and failure to prove to me as requested the interest rates, etc. over the period of time requested. Payments posted incorrectly, leading to even more interest payments,etc. The list would make this e-mail 3 times as long as it already is.

I am ready to fight back! Almost 8 years of this is ENOUGH! What I want to know is if anyone is aware of a class action attorney who might be interested in picking up a case against AES. I plan to research it. If I find, I will post.

I am in student loan HELL. I went to school in PA and got my Stafford Loans through PHEA. When I graduated from college I could not find a job right away so I put the loan on foreberance. When I did find I job, I began paying the interest back. When the payment grew to over $300 and I could no longer afford it and asked if the could reduce it, I was told no. I was crushed. I tried to apply for economic hardship but was told I did not qualify. I continued to pay what I could and would occasionally make balloon payments when I got my tax refund. In June 2004, I lost my sister to cancer and had to take in my two neices to keep them from going into foster care. I work for child protective services in Maryland and was not going to have my neices in the court system. I had to pay $250/per child to petitioned the courts in PA for legal guradianship of the children. Once the guardianship was granted, I had to move out of my one bedroom apartment to a large home. The children continued to grieve and refused counseling. They began acting out through fighting, skipping school, shoplifting. I missed a great deal of work going to court hearings because of their behavior. I had thousands of dollars in fines and restitution to pay as their guardian. Paying these fines, caused me to get behind in my car payment and it was repossessed. The children continued to act out and two management companies evicted us because of their behavior. I tried appealing to AES but they did not want to hear it. AES is taking my state and federal tax refund and has now begun to garnish my wages. They now leave me with $86 every two weeks feed and clothe myself and my neices and buy to get to work. I can no longer afford their health insurance and they are now forced to receive state medical assistance. I tried to apply for food stamps but was denied stating I make too much. I requested a hearing for economic hardship with the Department of Education but was told they do not have my loan and was referred back to AES. I tried reaching out to AES but was hung up on twice when I requested to speak to a supervisor. The only alternative they gave me was to pay $470/month to get it out of default. If I could afford that, i would not be in this situation. I am being furloughed on my job and taking a reduction in pay. How am I supposed to live? Can anyone out there help me or have any suggestions?

I am a co-signer for my brother's loan and it has gotten out of control. Half the loan is with a crooked debt collector who is trying to get me to settle -- the other half is still with AES who refuses to bring the monthly amount down to an amount he can afford. I do know a class action lawyer -- in fact my husband recently was plantiff on a recent class action suit. We are going to try and get in touch with him and see what he says.

I have been trying to request an Income Repayment Plan from AES for the past couple of months. I called prior to faxing in any documentation to verify the specific documents necessary for consideration. I was told that until the IBR request was processed no payment is due and that late fees will not be assessed to the account once it has been approved. Due to the fact that I have gotten divorced since my last tax return was submitted I made sure that I asked them about my ex-husband's signature verification for the forms. I was told that as long as I included the divorce decree, his signature would not be necessary. A couple weeks later, I received a notice in the mail that my IBR was denied due to a lack of signature. When I called back and inquired about it, explaining what I had been told during the previous conversation, I was told that they would re-submit the form. A couple weeks later, I received another denial. This time when I called, I was told that the IBR was not considered not because I had not signed every page of the tax forms. I signed them and faxed them back for resubmission after speaking with a supervisor to make sure that nothing else was missing for consideration. A couple of weeks later, I received a document that stated that my payments would be deceased but I owed the delinquent balance and late fees. A couple of weeks after that I received another denial letter stating that they were now missing the signatures on the original IBR request form itself. Now my account is delinquent 51 days and over $1000 overdue. I have two young children and am surviving off of unemployment. I depleted the unemployment deferment.
I spoke to a supervisor today named Elizabeth who was completely belligerent. When I asked her to review the notes on my account so that she could see that not one person stated that my IBR was not signed she denied my request. She said I'm not reading through your notes. When I asked her then how could she speak to me about an issue on my account if she doesn't read the background and she kept saying look I'm telling you what the issue is...then she proceeded to say "Would you like to sit on the phone while I read through the notes for thirty min." so I said "be my guest" and to that she replied No I am not doing that.
It is absolutely unbelievable to me that no one wants to assist you with resolving issues at this organization. They TRULY believe that they are above the law and beyond any point of accountability! I can't believe this is what we get for trying to better to quality of life for ourselves and our children.

National Collegiate Trust is who AES uses as there collection agent. I called National Collegiate Trust to work out a deal to make monthly payments of mine and my wife's student loans. Anthony was working with me and tried to help but wasn't able to. Anthony placed me on hold to see if there were any other programs to help my family out. Anthony actually put one of his goons on the line. The person whom I do not have a name for was condescending and said that the good thing was he was not in my shoes. All I want to do is pay our student loans but we can't pay more then $20 a month.

OMG I was just in tears and crying and so angry for about an hour until I got on here and read your post. The same exact thing has been happening to me! I have made over 4,500 dollars worth of payments towards AES in the past 4 months. The keep saying that everything is taken care of and after going into their Reduced Payment program I only have to pay 150$ a month. So then they take out the 150$ and then they are hounding me again saying Im deliquent on my loans, to the point where they are contacting my mother in laws husbands ex wife to try and reach me. Just about an hour or so ago I recieved a phone call from a lady stating she was calling from National Collegiate Trust, which I never realized it was AES until about 20min ago, stating that if I do not pay 16,000 dollars today that further actions will be taken meaning court and yadda yadda. However March 20, 235 was taken out of my account plus my monthly 150$ and then another 50$ on the 22 of March and another 50$ on April 8th but yet Im still deliquent!? I think they none know their ass from the whole in the ground. Apparently, Im not deliquent because Ive been paying but yet im still in collection is what I am being told. So now after almost 4,500 dollars later they claim Im in collections and deliquent yet again. So this time around, I told the lady that they just need to take me to court cause Im sick of this moneying me to death. Im starting to think that they are just wanting me to pay because ive been paying in large amounts from day 1 thinking that im behind, which I wasn't! And me being a fool have been feeding into this and now they are harassing me and my family to death! Its embarrassing for me to have to explain because ppl think that Im a low life who inst paying my debt when in fact im paying more than my monthly dues! Im totally on board calling BBB and the Attorney General!!!

My husband is in the same boat. Got private loans in 07 for school. told us the payments would be affordable but they lied. Hes been paying on them since o7 but supposably we used all deferement period and forbareance period. He is in school again and they still wont put on deferement. Know they expect us to pay almost 700 a month payment. Which we cant afford. Tell us his account number that we've paid on since 07 is not the right account number. So where has all our money gone. He asked to get it lowered they said no. After an hour on the phone with them they said make what u can every month. Thats fine and all but my mother is the co-signer and is retired and doesnt have the money either and know it going to affect her credit. Needless to say we are meeting with an attorney to get this resolved. We are also pa residents.

Loan always create a treble situation specially in future because it play a role of beyond approach in the sense will never come in future. So never should take loan in any case.

I am interested in jumping in a class action suit. Now, I owe $60k- I just defaulted on a loan. I cannot afford to make these payments. It's unfortunate to see people try to go to school, but they struggle to make payments when they graduate. This is a weird question, but how was AES able to approve people for private loans, and NEVER asked for proof of income? Is it me, or is it predatory lending? I spoke with a rep today, and he said that AES never approved loans; they are only a servicer-not true!
